Biography
Evan advises companies of all sizes on matters pertaining to technology and intellectual property. His practice covers a wide range of related issues, including licensing, online services, technology development, big data and analytics, the internet of things, social media, domain names, and copyright and trademark protection. Evan’s keen awareness of technological innovation – especially concerning AI – equips him to provide effective counsel and insight in negotiation, compliance, risk management and dispute resolution.
Evan has extensive experience negotiating and drafting licensing and master service agreements for both providers and users of hosted services in many industries, including commercial airlines, delivery services, hotels and restaurants, commercial real estate, and food safety. His counsel helps his online service provider clients enter into the safe harbor protections of the Digital Millennium Copyright Act (DMCA) and to enjoy the immunity provided by the Communications Decency Act (Section 230). He also advises companies in structuring and executing sophisticated reseller, referral partner and other similar arrangements.
In addition to his transactional practice, Evan counsels and represents clients in dispute resolution. He is an experienced litigator in federal and state court, defending and asserting clients’ rights in copyright and trademark infringement disputes, breach of contract, and matters related to unauthorized access to computer systems and communications.
Evan has decided hundreds of cases as a panelist for the World Intellectual Property Organization located in Geneva, Switzerland, hearing domain name disputes under the UDRP. He brings his deep experience as a WIPO panelist to client matters, prosecuting cases for clients to successfully enforce their intellectual property rights against cybersquatters and other opportunistic online actors.
Evan is an adjunct professor at Chicago-Kent College of Law, where he teaches a full semester course to second and third-year law students on negotiation strategies and techniques. He is a frequent public speaker, author and commentator on a wide variety of topics related to law, technology and new media.
